Welcome to Pender Pro. These Terms of Service ("Terms") govern your use of our website at penderpro.com, your communications with us, and any services we provide. By using our website or requesting services, you agree to these Terms.
Pender Pro is a locally owned fence company based in Evans, Georgia. We offer fence installation, repair, and staining services across the Central Savannah River Area (CSRA), including Augusta GA, Evans GA, Grovetown GA, Martinez GA, Aiken SC, North Augusta SC, and surrounding communities.
You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to:
Estimates we provide are based on the information you give us and an on-site inspection. They are valid for the period stated on the quote (typically 30–60 days) unless explicitly extended in writing. Final pricing may be adjusted to reflect site conditions discovered during work that were not visible at the time of the estimate (e.g., buried utilities, undisclosed structures, hidden rot), with notice to you before additional work is performed.
Estimates are not binding contracts to perform work. A contract is formed only when both parties have signed a written agreement or you have otherwise accepted our quote in writing (including email).
We schedule installations based on workload, weather, and material availability. We will provide you with an expected start date and will communicate proactively if that date changes due to weather, supply chain delays, or other factors outside our reasonable control.
You agree to provide reasonable site access, identify any underground utilities by calling 811 (Georgia 811 or SC811) before our crew arrives if required, and remove obstacles within the work area in advance of the start date unless we have agreed to handle that work for an additional charge.
Unless otherwise agreed in writing, our standard payment terms are:
Late payments may accrue interest at the maximum rate permitted by law. We reserve the right to suspend work or place a lien on the property in accordance with Georgia or South Carolina mechanics' lien statutes if payment becomes more than 30 days overdue.
Pender Pro stands behind its work. Specific warranty terms — coverage period, what's included, exclusions, and claim procedures — are provided with each written quote and final contract. Unless otherwise stated in your written contract:
You are responsible for confirming property line locations, easements, and obtaining any required HOA approvals before work begins. We will assist with permits where customarily required and will install to applicable code, but we are not liable for delays, rework, or removal costs resulting from inaccurate boundary information, unapproved HOA installations, or undisclosed easements.
You may cancel a signed contract within the rescission period required by Georgia or South Carolina law (typically 3 business days for residential home-improvement contracts). After that period, cancellations are subject to forfeiture of deposit and reimbursement of any non-refundable materials already ordered or work already performed.
To the maximum extent permitted by law, Pender Pro's total liability arising out of or related to your use of our website or our services is limited to the amount you actually paid us for the specific project giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or loss of goodwill).
Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
All content on our website — text, graphics, photographs, logos, and design — is owned by Pender Pro or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use, but may not reproduce, redistribute, or use our content for commercial purposes without prior written permission.
The "Pender Pro" name and logo are trademarks of Pender Pro. You may not use them without our written permission.
We may photograph our work for portfolio, marketing, and quality-control purposes. Photographs typically show the fence and immediate surroundings, not identifying features of the property or its occupants. If you would prefer we not photograph your project, please let us know in writing before work begins and we will accommodate.
If you post a review of our services (e.g., on Google, Facebook, the Better Business Bureau, or our website), you grant us a non-exclusive, royalty-free, perpetual license to display that review with attribution. You retain ownership of your review and can request removal of any review you authored.
You agree to indemnify and hold Pender Pro harmless from claims arising out of your breach of these Terms, your violation of any law, or your violation of any third-party rights, except to the extent caused by our own negligence or willful misconduct.
Our website is provided "as is" and "as available." We make no warranties about its accuracy, completeness, uninterrupted availability, or freedom from errors. Pricing, availability, and service area information may change without notice.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Columbia County, Georgia, and you consent to personal jurisdiction in those courts.
Before filing any formal claim, you agree to first contact us at the address below and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms from time to time. The "Effective Date" at the top reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
